For the purposes of these Terms and Conditions:

• "Client," "You," and "Your" refers to you, the person or entity accessing our website and accepting these terms and conditions.
• "The Company," "Ourselves," "We," "Our," and "Us," refers to Kasot Press.
• "Party," "Parties," or "Us," refers to both the Client and ourselves.
• "Services" refers to the printing and related services offered by Kasot Press.
• "Products" refers to all printed materials and goods produced or sold by Kasot Press.
• "Website" refers to Kasot Press's website, accessible at www.kasotpress.com.
• "Content" means any material, information, or data, including text, images, videos, audio, or other material that is posted, uploaded, or otherwise made available on the Website.
• "Order" refers to a request placed by you for our products or services.

3. Services and Products

Kasot Press provides a range of printing services including but not limited to business cards, flyers, brochures, banners, corporate gifts, ID cards, notepads, posters, and other printed materials as described on our website.

All products and services are subject to availability. We reserve the right to discontinue any product or service at any time.

Product descriptions, images, and specifications are for illustrative purposes only. While we strive for accuracy, we do not guarantee that all descriptions, images, or specifications are accurate, complete, reliable, current, or error-free.

We reserve the right to refuse service to anyone for any reason at any time.

We reserve the right to make changes to our services, prices, and policies at any time. We will notify customers of any significant changes by updating the website.

4. Orders and Payment

By placing an order with us, you agree to provide current, complete, and accurate purchase and account information.

All orders are subject to acceptance and confirmation by us. We reserve the right to refuse or cancel any order for any reason, including but not limited to product or service availability, errors in the description or price of the product or service, or errors in your order.

Payment must be received prior to the commencement of any work unless otherwise agreed in writing. We accept payment via the methods specified on our website.

All prices are in Nigerian Naira (NGN) unless otherwise stated and are subject to change without notice. We reserve the right to modify or discontinue any service without notice. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the service.

For custom orders, a 50% non-refundable deposit may be required before work begins, with the remaining balance due before delivery of the final product.

5. Artwork and Content

You are responsible for providing print-ready artwork that meets our specifications. We are not responsible for checking or correcting errors in your artwork unless you specifically request and pay for our design services.

We may provide design services for an additional fee. Any designs created by us remain our intellectual property until full payment is received, after which you will be granted a license to use the design for the specific purpose it was created for.

By submitting content to us for printing, you warrant that:

• You own or have the right to use any intellectual property contained within the content.
• The content does not infringe upon the intellectual property rights of any third party.
• The content is not unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• The content does not contain any material that could give rise to civil or criminal liability under applicable laws.
• The content does not contain any material that promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age.

We reserve the right to refuse to print any content that we believe violates these terms or is otherwise inappropriate.

We may keep copies of your artwork and content for a reasonable period for record-keeping purposes, but we are not obligated to store or maintain any files after your order has been completed.

6. Proofing and Approval

For custom orders, we may provide digital or physical proofs for your approval before final production. It is your responsibility to carefully review all proofs for errors or omissions.

Your approval of a proof, whether by email, in writing, or by other means, indicates your acceptance of the design, layout, text, and overall appearance of the product. We are not responsible for errors that were present in the approved proof.

If you waive the right to receive and approve a proof, you accept full responsibility for any errors or omissions in the final product.

7. Production and Turnaround Time

Production time begins after we receive your payment and approved artwork. Turnaround times are estimates only and are not guaranteed.

We are not responsible for delays due to circumstances beyond our control, including but not limited to supplier delays, equipment failures, power outages, natural disasters, or other force majeure events.

Rush orders may be available for an additional fee, subject to our capacity and availability.

8. Delivery and Shipping

Delivery times are estimates only and are not guaranteed. We are not responsible for any delays caused by shipping carriers or other circumstances beyond our control.

Risk of loss and title for items purchased pass to you upon delivery of the items to the carrier.

You are responsible for providing accurate shipping information. We are not responsible for orders that are delayed or not delivered due to incorrect shipping information.

Shipping costs are calculated based on the weight, dimensions, and destination of your order. Additional charges may apply for expedited shipping, remote locations, or special handling requirements.

You are responsible for any customs duties, taxes, or other charges that may be imposed by authorities in your country or region.

9. Inspection and Acceptance

You should inspect all products immediately upon receipt. Any claims for defects, damages, or shortages must be reported to us within 7 days of receipt.

Failure to notify us of any defects, damages, or shortages within 7 days of receipt will constitute acceptance of the products as delivered.

10. Refunds and Returns

Due to the custom nature of our products, all sales are final unless the product is defective or damaged upon receipt.

If you receive a defective or damaged product, you must notify us within 7 days of receipt. We may require photographic evidence of the defect or damage.

If we determine that the product is defective or damaged due to our error, we may, at our discretion:

• Reprint and ship a replacement product at no additional cost to you.
• Provide a partial or full refund.
• Offer a credit toward future orders.

We are not responsible for any errors in your artwork or content that result in printing errors.

Color variations between your screen display, printed proofs, and final printed products are normal and are not considered defects.

Minor variations in cutting, folding, or finishing are inherent in the printing process and are not considered defects.

11. Intellectual Property

The website and its original content, features, and functionality are owned by Kasot Press and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
• You may store files that are automatically cached by your Web browser for display enhancement purposes.
• You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

If we create custom designs for you, we retain ownership of those designs until full payment is received, after which you will be granted a non-exclusive license to use the designs for the specific purpose they were created for.

We reserve the right to use images of products we produce for you in our portfolio, marketing materials, and social media, unless you specifically request otherwise in writing.

13. Limitation of Liability

In no event shall Kasot Press, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the service;
• Any conduct or content of any third party on the service;
• Any content obtained from the service;
• Unauthorized access, use or alteration of your transmissions or content;
• Errors or omissions in the content or operation of our website;
• Delays or inability to use our website or related services;
• Any defects or errors in your printed products that were present in your approved artwork or proofs;
• Any damage to your computer, hardware, software, or data resulting from your use of our website or services.

Our total liability to you for all claims arising from or related to your use of our website or services shall not exceed the amount you paid for the specific order giving rise to the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless Kasot Press, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms and Conditions;
• Your use of our website or services;
• Your content or artwork submitted for printing;
• Any infringement of intellectual property rights or other rights of any third party.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or your use of our website or services shall be resolved exclusively in the courts of Nigeria.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

16. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the service.

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Kasot Press regarding your use of our website and services, and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter.
